NPDB Reporting

It is difficult to underestimate the impact that a National Practitioner Databank (NPDB) report can have on a physician’s professional career. For hospitals and other reporting entities, it is critical to follow the rules, regulations, and guidelines that govern reporting to the NPDB. A misstep in this regard can cause lengthy and costly litigation.

It is equally important for subjects of NPDB reports to play a role in the reporting process and verify, if possible, that the language of the NPDB report is true and accurate. When necessary, providers should also take advantage of the administrative remedies available under NPDB rules and regulations, such as placing a report in disputed status and adding commentary regarding the language of the report itself. When a reporting entity has failed to follow the NPDB’s rules and regulations, some circumstances warrant investigation and intervention by the Office of the Secretary of the Department of Health and Human Services.

Dan advises reporting entities and providers on all matters regarding NPDB reporting. He has helped reporting entities avoid litigation and mitigate risk. Dan has also helped reporting entities navigate the administrative process when a NPDB report comes under threat.

Dan has handled similar matters on behalf of physicians, including litigation. Dan’s litigation experience in this area includes seeking injunctive relief relevant to false or misleading NPDB reports; persuading reporting entities to withdraw or void NPDB reports; and pursuing claims for defamation and interference with economic relationships.
